ARVISCRUBHUB TECHNOLOGIES PRIVATE LIMITED

These Terms of Use (“Terms”) govern your access to and use of the ArviScrubHub platform, including the website (arviscrubhub.com), mobile application, and all related services, products, subscriptions, and marketplace offerings (collectively, the “Platform”).

ArviScrubHub Technologies Private Limited is a company incorporated in India, with its registered office at Raghunath nagar, Ambika nagar no. 3, Thane west, Thane, Maharashtra - 400 604 India (hereinafter referred to as “ArviScrubHub”, “Company”, “we”, “us”, or “our”).

By accessing, browsing, registering, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Platform.

1. DEFINITIONS AND KEY TERMS

  • Account: A registered user profile created on the Platform.
  • ArviScrubHub Prime: A premium, non-refundable subscription offering priority service access and exclusive benefits for a specified validity period.
  • ArviScrub Credits: Promotional digital credits representing discount value for eligible purchases on the Platform. Credits have no cash value, are non-transferable, and are subject to expiry.
  • Marketplace: The integrated digital marketplace where ArviScrubHub and approved third-party sellers offer products and services.
  • Order: A confirmed booking for Services or purchase of Products made through the Platform.
  • Platform: The ArviScrubHub website, mobile application, and all associated digital systems.
  • Products: Physical goods, consumables, accessories, packages, or merchandise offered through the Platform.
  • Services: Doorstep vehicle cleaning, washing, grooming, detailing, and related automotive care services.
  • Service Partner / Merchant: Independent third-party professionals or sellers registered on the Platform.
  • Third-Party Seller: Any external vendor or service provider offering products or services via the Platform.
  • User / You: Any individual or entity accessing or using the Platform.

2. ACCEPTANCE AND ELIGIBILITY

2.1 Binding Agreement

By creating an Account, placing an Order, or using the Platform, you confirm your acceptance of these Terms, the Privacy Policy, and all related policies.

2.2 Eligibility

To use the Platform, you must:

  • Be at least 18 years of age
  • Be a resident of India with a valid mobile number and address
  • Communicate service updates, confirmations, and support
  • Have legal capacity under the Indian Contract Act, 1872
  • Comply with all applicable laws

2.3 Minors

Users below 18 years may use the Platform only under parental or legal guardian supervision, with the guardian accepting these Terms.

2.4 Business Use

If using the Platform on behalf of an organization, you confirm that you are authorized to bind that organization.

3. PLATFORM ROLE AND SERVICE NATURE

3.1 Technology Intermediary

ArviScrubHub operates as a technology-enabled marketplace, facilitating connections between Users and independent Service Partners or Third-Party Sellers. ArviScrubHub does not directly perform services unless expressly stated.

3.2 Service Scope

Services include vehicle washing, interior cleaning, grooming, detailing, and allied automotive care services, subject to availability.

3.3 Marketplace Offerings

The Platform may offer vehicle care products, service packages, subscriptions, accessories, and third-party offerings.

3.4 Third-Party Services

Certain offerings (including insurance or value-added services) are provided by third parties and governed by their respective terms. ArviScrubHub acts solely as a facilitator.

3.5 No Guarantee

Service availability, outcomes, or suitability for specific expectations are not guaranteed.

4. ACCOUNT REGISTRATION AND SECURITYy

  • Users must provide accurate, current, and complete information.
  • Users are responsible for maintaining Account confidentiality.
  • Only one Account per User is permitted.
  • ArviScrubHub may suspend or terminate Accounts for policy violations, fraud, or legal requirements.

5. LOCATION DATA AND GPS USAGE

By booking Services, you consent to the collection and use of precise GPS and address data for:

  • Service delivery and navigation
  • Safety and verification
  • Dispute resolution

Disabling location access may restrict service availability. Location data is treated as sensitive personal data under the Digital Personal Data Protection Act, 2023.

6. BOOKINGS, SERVICE DELIVERY & USER OBLIGATIONS

  • Orders are confirmed only after successful payment.
  • Service assignment depends on availability and operational factors.
  • Timings are estimates and may vary.
  • Users must provide safe parking, water/electricity (if required), and remove personal belongings.
  • Services may be refused due to unsafe conditions or inaccurate booking details. Refunds in such cases are issued as ArviScrub Credits.

7. PRICING, PAYMENTS & BILLING

  • Prices are shown upfront and include applicable taxes unless stated otherwise.
  • Payments are processed via RBI-compliant third-party gateways.
  • ArviScrubHub does not store card details.
  • Surge or dynamic pricing may apply and is disclosed before confirmation.

8. ARVISCRUB CREDITS PROGRAM

  • Credits are promotional, non-cash, non-transferable, and platform-restricted.
  • Credits may be earned via promotions, referrals, loyalty programs, or bundled offers.
  • Each credit has a defined expiry date and cannot be reinstated once expired.

9. VALUABLES AND LIABILITY DISCLAIMER

Users must remove all valuables before service. ArviScrubHub and Service Partners are not liable for loss, theft, or damage to personal belongings left inside vehicles.

10. SERVICE PHOTOGRAPHY

Users authorize capture of photos/videos of vehicles for quality control, proof of service, dispute handling, and fraud prevention. Media is stored securely and not publicly disclosed without consent unless required by law.

11. CANCELLATIONS & REFUNDS

  • Cancellation charges depend on service type and timing.
  • Refunds are issued primarily as ArviScrub Credits.
  • Cash refunds are provided only when legally mandated (e.g., payment failures or duplicate charges).
  • Subscription fees and promotional credits are non-refundable.

12. SUBSCRIPTIONS (ARVISCRUBHUB PRIME)

  • Prime subscriptions are non-refundable and valid for the specified period.
  • Benefits may change with notice.
  • Auto-renewals comply with RBI e-mandate guidelines.

13. PRIVACY & DATA PROTECTION

ArviScrubHub is the Data Fiduciary under the DPDP Act, 2023. Personal data is collected solely for service delivery, payments, support, analytics, compliance, and marketing (with consent).

Users retain rights to access, correct, erase data, and raise grievances.

14. USER CONDUCT

Users must not engage in unlawful, abusive, fraudulent, or harmful activities. Violations may result in suspension, forfeiture of credits, cancellation of orders, or legal action.

15. LIMITATION OF LIABILITY

ArviScrubHub’s liability is limited to the Order value paid. The Platform is provided “as is”, without warranties. Indirect or consequential damages are excluded.

16. INTELLECTUAL PROPERTY

All Platform content and technology are owned or licensed by ArviScrubHub. Unauthorized copying or commercial use is prohibited.

17. INDEMNIFICATION

Users agree to indemnify ArviScrubHub against claims arising from misuse of the Platform, legal violations, or breach of these Terms.

18. GOVERNING LAW & DISPUTE RESOLUTION

  • Governed by Indian law
  • Jurisdiction: Courts in India
  • Disputes resolved through arbitration under the Arbitration and Conciliation Act, 1996
